FOREIGN EXPERIENCE OF LEGISLATIVE SUPPORT OF LAND USE PLANNING

Abstract (English):
The educational and scientific manual is intended for students studying in the direction of preparation of land management and cadastre (21.03.02, 21.04.02) and jurisprudence (40.04.01). It analyzes the experience of organizing land management activities and its legislative consolidation: 1) in the PRC, where the regulation of land relations, land use and land management is highly developed and detailed and at the same time largely retained the approaches that developed in the conditions of a planned economy; 2) in the USA, where the organization of land use and its legislative regulation is based on the traditions and instruments of common law and on public-private partnership; and 3) in the Federal Republic of Germany, where the legislative regulation of land management corresponds to the approaches inherent in the German-Roman legal family, and is also of greater interest in view of the organization of such regulation, both at the national level and at the level of the Federal Republic of Germany, as regions of the federal state. The study of the material outlined in the manual will allow students to master the competencies provided for by the relevant educational standard, as well as to contribute to the formation of a systematic perception of the legal support of land management and cadastres among students. Also, the manual will be useful for the subsequent analysis of the legislative support of the domestic institute of land management in comparison with the named countries and determining the possible prospects for its development. In this regard, the manual is also of interest to a wide range of land surveyors, cadastral engineers and other persons interested in the problems of organizing the rational use of lands and their protection.
